Kashmir and International Law: Why Pakistan Cannot Demand UN Resolution Implementation
The Kashmir dispute is widely discussed but rarely understood in its legal context.
This video/article offers a factual breakdown of the UN resolution on Jammu & Kashmir, Pakistan’s obligations, and why the plebiscite never took place. Most importantly, it explains how later bilateral agreements — Tashkent (1966), Shimla (1972), and Lahore (1999) — supersede the earlier UN plan.
We examine the three-step structure of the 1948–49 UN resolution, which clearly required Pakistan to withdraw all troops and irregulars from Pakistan-Occupied Kashmir before India was obligated to reduce its forces. Because Pakistan never completed the withdrawal, the mandatory first step was never triggered. As a result, the plebiscite clause never became legally operative.
The blog/video also highlights how Pakistan became a signatory to multiple bilateral peace treaties, each requiring both nations to resolve issues mutually — without international intervention. The Shimla Agreement remains legally binding and is reaffirmed in the Lahore Declaration. Today, the UN itself acknowledges that Kashmir must be settled only through bilateral negotiations. This means Pakistan has no legal standing to demand enforcement of the earlier UN resolution that it did not comply with and later replaced through bilateral commitments.
